Lawsuit ? Matthew David Stewart says he?s entitled to additional funds.
An Ogden man accused of gunning down a task force officer during a deadly drug raid on his home has sued his insurance company for breach of contract.
Matthew David Stewart, 38, claims in addition to money owed to repair his home following a Jan. 4, 2012, shootout with Weber Morgan Narcotics Strike Force agents, he?s also owed for biohazard cleanup and loss of rent at $40 per day ? the same amount he?s allegedly being charged for his incarceration while awaiting trial.
The lawsuit filed Jan. 4 claims that Stewart?s insurers ? Fire Insurance Exchange and Farmers Insurance Group ? have breached their contract pertaining to coverage on the house at 3268 Jackson Ave.
Stewart remains incarcerated, charged in 2nd District Court with aggravated murder for strike force Agent Jared Francom?s death. Stewart He is also charged with seven first-degree felony counts of attempted aggravated murder for allegedly trying to kill other officers, and one second-degree felony count related to alleged marijuana cultivation. Stewart has pleaded not guilty on all counts.
According to insurance appraisal documents provided by Stewart?s lawyer, the insurance company estimated the shootout caused about $8,400 in damage to the home ? about $4,800 of that was not recoverable due to depreciation of the home. The company cut Stewart and his mortgagee a check for the actual cash value of $3,321.29 to cover the damage.
Stewart returned the check to the insurance company because he contended he was entitled to the additional payments.
In a letter, the insurance company wrote that there is no coverage under Stewart?s policy for what he is claiming, according to court documents.
The company also points out the policy is void if Stewart commits an "intentional act," which is defined as directly causing or arranging damage to his home in order to obtain insurance benefits.

WASHINGTON/NEW YORK (Reuters) - The United States ordered a wide review of Boeing's latest passenger jet, the 787 Dreamliner, citing "concern" over a spate of technical problems in recent weeks.
Regulators said the Dreamliner remained safe to fly but a thorough examination was needed to identify the root cause of the problems including a fire on a parked 787 on Monday.
"There are concerns about recent events involving the Boeing 787. That is why today we are conducting a comprehensive review," Transportation Secretary Ray LaHood told a news conference.
The review will put an emphasis on the 787's advanced electrical systems and cover their design, manufacture and assembly, the Federal Aviation Administration said.
The move comes on top of a separate probe by U.S. safety investigators into a battery fire which caused "serious damage" to an empty Japan Airlines 787 jet at Boston airport on Monday.
Adding to incidents that have tested confidence in the world's first mainly carbon-composite airliner, the jet suffered a cracked cockpit window and an oil leak on separate flights in Japan on Friday.
The 787 is Boeing's newest jet and its boldest effort to revolutionize commercial aviation by using new technology to cut the fuel cost for operating the plane by 20 percent.
Each lightweight jet has a list price of $207 million.
Airlines are pleased with the savings, and have so far given the plane their approval, both by ordering more than 800 jets and mostly sticking by it through the current spate of troubles.
But Boeing already is far over its budget and more than three years behind schedule in delivering Dreamliner planes.
Shares of Boeing fell 2.5 percent to $75.17 in early trading on Friday.
The wide-ranging review by U.S. officials has the potential to deal a setback to Boeing's newest jet, especially if it leads to a costly design change.
It is also a significant test for the recently-appointed chief executive of Boeing's commercial airplanes division, Ray Conner, who also attended Friday's Washington news conference.
Conner, who was previously Boeing's commercial sales chief, said the company was committed to making the plane as reliable as possible and that its backup systems had been working well.
"We have complete confidence in the 787 and so do our customers," Conner said.
The Federal Aviation Administration wants to maintain public confidence in the Dreamliner, FAA Administrator Michael Huerta said.
LaHood said he would not hesitate to fly on a 787 himself.
BOEING CONFIDENCE
A growing media storm about the 787 glitches echoes global publicity a year ago over wing cracks on the A380 superjumbo, built by Boeing's European rival Airbus.
The A380 has also been deemed safe to fly and few airlines have reported a dip in bookings, but the problems are expected to end up costing Airbus up to 500 million euros in repairs.
In both cases, everyday glitches have been swept up in the wider storm of publicity and attracted unusual attention, along with more serious problems.
"I can't think of any similar investigations, but apart from the battery fire, all the other things we have seen are 'so what?'" Paul Hayes, safety director at aviation consultancy Ascend, said of the FAA review.
The 787 Dreamliner made its first commercial flight in late-2011 after a series of production delays put deliveries more than three years behind schedule. By the end of last year, Boeing had sold 848 Dreamliners. It now has 50 in service.
Conner said the recent issues had not been caused by either outsourcing production or boosting it too quickly.
"We have complete confidence in the 787 and so do our customers," he said.
The 787 makes extensive use of electrical components to perform tasks previously carried out by heavier equipment such as hydraulics.
In India - where state-owned Air India has taken delivery of six Dreamliner jets and has more on order - a senior official at the aviation regulator said there was concern at the recent spate of Dreamliner glitches.
The Directorate General of Civil Aviation has not ordered any Dreamliner checks for now, but is waiting for a safety report on Monday's fire from the U.S. National Transportation Safety Board, the official said.

Unlike any Martian meteorite scientists have studied so far, the new object, tagged as NWA 7034, has a composition similar to the planet's crust. Indeed, the sample is similar to rock and soil samples seen by rovers Spirit and Curiosity ? the first time scientists have been able to link a meteorite to rocks analyzed on the surface of the red planet, according to a team from the US and China formally reporting its results in Friday's issue of the journal Science.
It is the 2 billion-year-old meteorite's volcanic origin and its apparent interactions with water and the atmosphere at or near the Martian surface that may have turned it into such an intriguing a time capsule.
"Having this sample from 2 billion years ago may give us a little bit of a glimpse of what the surface conditions were like" during a poorly understood period in Mars's history, says Carl Agee, the team's leader and director of the Institute for Meteoritics at the University of New Mexico in Albuquerque.
The rock was formed during the early years of Mars's Amazonian epoch. The epoch is thought to have started between 3.5 and 1.8 billion years ago and was marked, among other things, by the formation of the solar system's largest volcano, Olympus Mons, as well as by volcanic activity elsewhere on the planet.
The 11-ounce meteorite's mix of minerals and its rubble-like composition speak to a violent beginning ? rising toward the surface in an explosive, Mt. St. Helens-style volcanic eruption, Dr. Agee says.
Surprisingly, the meteorite boasts some 10 times the water of other, younger Martian meteorites, although the amount is still tiny. The team initially estimated that the meteorite held up to 3,000 parts per million in water, half of which the rock accumulated after landing on Earth. Further measurements, however, showed that the rock held up to twice the water the team initially calculated. And virtually all of it was of extraterrestrial origin, Agee says.
Moreover, the measurements suggested that the meteorite's water came from at least two sources ? magma and water at or near the planet's surface. This water, perhaps melted permafrost or a surface pool, reacted with the rock while it was still too hot to handle.
NWA 7034 also hosts complex organic molecules, which can have biological as well as nonbiological sources.

?Other Martian meteorites have contained polycyclic aromatic hydrocarbons, which had nonbiological origins. The team is now examining NWA 7034's nonbiological organic molecules to see if they are similar to those found in earlier Martian meteorite samples, writes Andrew Steele, an astrobiologist at the Carnegie Institution for Science in Washington, in an e-mail exchange. Ongoing research aims to use the rock's interaction with cosmic rays to determine how long it took to reach Earth from Mars. Nor have they yet pinned down the length of time it sat in the desert before a meteorite hunter picked it up in 2011. Based on the amount of weathering the specimen displayed, Agee estimates that NWA 7034 might have landed several hundred years ago.
Colleagues are also cataloging the relative abundance of gases trapped in tiny pockets to tease out clues as to the makeup of the planet's atmosphere at the time the rock reached the surface.
?The contents of this meteorite may challenge many long held notions about Martian geology,? said John Grunsfeld, associate administrator for NASA?s Science Mission Directorate in Washington, in a statement. ?These findings also present an important reference frame for the Curiosity rover as it searches for reduced organics in the minerals exposed in the bedrock of Gale Crater.?

Jan. 9, 2013 ? Mussels can be a mouthwatering meal, but the chemistry that lets mussels stick to underwater surfaces may also provide a highly adhesive wound closure and more effective healing from surgery.
In recent decades bioadhesives, tissue sealants and hemostatic agents became the favored products to control bleeding and promote tissue healing after surgery. However, many of them have side effects or other problems, including an inability to perform well on wet tissue.
"To solve this medical problem, we looked at nature," said Jian Yang, associate professor of bioengineering at Penn State. "There are sea creatures, like the mussel, that can stick on rocks and on ships in the ocean. They can hold on tightly without getting flushed away by the waves because the mussel can make a very powerful adhesive protein. We looked at the chemical structure of that kind of adhesive protein."
Yang, along with University of Texas-Arlington researchers Mohammadreza Mehdizadeh, Hong Weng, Dipendra Gyawali and Liping Tang, took the biological information and developed a wholly synthetic family of adhesives. They incorporated the chemical structure from the mussel's adhesive protein into the design of an injectable synthetic polymer. The bioadhesives, called iCMBAs, adhere well in wet environments, have controlled degradability, improved biocompatibility and lower manufacturing costs, putting them a step above current products such as fibrin glue and cyanoacrylate adhesives.
Fibrin glues are fast acting and biodegradable but have relatively poor adhesion strength. They may also carry risk of blood-borne disease transmission and have the potential for allergic reactions due to animal-based ingredients. Cyanoacrylate adhesives -- super glues -- offer strong adhesion, rapid setting time and strong adhesion to tissue, but they degrade slowly and may cause toxicity, often limiting their use to external applications.
Additionally, neither product is effective when used on wet tissue, a requirement of internal organ surgery, nor are there any current commercially available tissue adhesives or sealants appropriate for both external and internal use.
The researchers tested the newly developed iCMBAs on rats, using the adhesive and finger clamping to close three wounds for two minutes. Three other wounds were closed using sutures. The researchers reported their findings in a recent issue of Biomaterials.
The iCMBAs provided 2.5 to 8.0 times stronger adhesion in wet tissue conditions compared to fibrin glue. They also stopped bleeding instantly, facilitated wound healing, closed wounds without the use of sutures and offered controllable degradation.
"If you want the material to stay there for one week, we can control the polymer to degrade in one week," said Yang. "If you want the material to stay in the wound for more than a month, we can control the synthesis to make the materials degrade in one month."
The iCMBAs are also non-toxic, and because they are fully synthetic, they are unlikely to cause allergic reactions. Side effects were limited to mild inflammation.
"If you put any synthetic materials into your body," said Yang, "the body will generate some inflammation."
The researchers are now working on improving the formula.
"We are still optimizing our formulation," said Yang. "We are still trying to make the adhesion strength even stronger" to expand its use for things like broken bones where strong adhesion is tremendously important.
The researchers are also looking at adding in components that could control infection.
"We can introduce another component with anti-microbial properties, so it can do two functions at once," said Yang.
The iCMBAs could eventually be used in a wide range of surgical disciplines from suture and staple replacement to tissue grafts to treat hernias, ulcers and burns.
"There are so many applications that you can use this glue for to help in surgery," said Yang.

Anyways, so I went home to the province for the holidays and I left my Bioderma there. ?I know I still have tons of makeup removers here in Manila (Shu, Revlon, Dove..) but I usually prefer using an eye makeup remover, then my trusted Ponds cold cream and then tissue off everything. ?You know I still believe in "pasma" (how do you say that in Tagalog?) so I'd like to rest my face for a while before finally washing with water. But when I'm in a hurry or if I sort of know that I'd be dozing off to sleep right away, I'd use my oil cleansers.?
Knowing that I left my trusted Bioderma, I knew I had to buy a temporary alternative. ?I went around SM Department Store, saw an Etude counter and accidentally saw this while checking out their brow mascara. ?They have a lot of makeup removers, some are only intended for mascaras. ?Of course, I'll get the one that could give me greater value for my moolah, so I got this:
Etude Lip & Eye (Makeup) Remover
Gently, yet effective, this double formulated lip & eye (makeup, sorry I can't help it! LoL) remover easily and instantly dissolves all traces of makeup for a soothing and moisturizing effect on the sensitive eye and lip area without any irritation.
It has two layers of solution: clear and bluish-green. ?I've read that this one has changed its packaging, or maybe the formulation? Because previously, it's a lot bluer and the blue part is on top. While now, it became bluish-green and the colored part is now at the bottom. ?
Anyways, like any other bi-layer solutions, you are supposed to shake it like crazy and make sure that the two layers mix. ?I'm glad that this one comes in a plastic bottle, or else, I might have broken it the first time I got my hands on it. ?Yes, I am lousy like that!
Now let's see if this stuff really works:

I pour a small amount on a cotton pad...
...press it on the eye area, let it stay there for a minute
...and then gently slide the cotton downwards. ?Go back and gently wipe off the remaining makeup if needed.
and voila!
oh yes, this baby can remove everything!
No blurry vision, no oily residue after. just cleansed peepers! I've also used it on my lips when I wore the Revlon Colorstay Ultimate Suede lipstick and I wasn't able to taste anything. ?And no, I don't have colds! (laughs) ?It didn't even taste like oil. ?Parang, wala lang.The best part? ?It's cheap. ?Only Php198 for a 100ml bottle.
So yeah, instead of being just temporary, this one's going to be a staple.

On the bilateral meeting with His Excellency Fumio Kishida, Foreign Minister of Japan

Today, I had the pleasure of meeting His Excellency Fumio Kishida, the newly-appointed Foreign Minister of Japan. The Philippines is the first country that His Excellency has visited since his appointment as Japan?s foreign minister, for which we are deeply honored. The official visit of Foreign Minister Kishida also reaffirms the strategic partnership between the Philippines and Japan.
We had productive discussions on various important bilateral as well as regional issues, such as trade, investments, tourism, development assistance, people-to-people exchanges and maritime security, and the Mindanao peace process.
Japan is the Philippines? number one trade partner with total trade exceeding $13 billion last year. Japan also remains as the Philippines? top export market for 2012.
Japan has been the Philippines? number one source of approved investments since 2009 with approved investments reaching P22.35 billion in the 1st half of 2012 alone. The Philippines is also looking into possible collaboration in the promotion of investments with Japanese small- and medium-scale enterprises (SMEs).
Japan remains the number one source of development assistance in terms of loans. Thus, the Philippines looks forward to stronger cooperation with Japan in developing our country?s infrastructure particularly in the transportation sector.
Japan ranks third in tourist arrivals, as there were 375,248 Japanese tourist arrivals between January to November 2012.
The people-to-people exchanges have deepened the ties of friendship and understanding between the Philippines and Japan. Capacity development programs promote the development of Philippine human resources, particularly in the public sector, while cultural programs provide opportunities for the youth of both countries to learn about each other?s culture fostering friendships on the basis of mutual respect and understanding.
The Philippines-Japan Economic Partnership Agreement(PJEPA) is the Philippines? first and only bilateral Free Trade Agreement (FTA) and the Philippines wishes to maximize the opportunity to improve the Agreement and mutually reap its economic benefits. I hope that our two governments would continue exploring both short-term and long-term solutions to help Filipino healthcare workers to be accepted by Japanese healthcare institutions.
On maritime security, the Japanese government has been assisting the Philippines in strengthening the capacity of the Philippine Coast Guard through human resource development and augmentation of much needed communications system equipment for maritime safety. The acquisition of multi-role response vessels is undergoing serious consideration. There is also regular exchange of views and dialogue between officials of the two countries on maritime and ocean affairs.
I thanked the Foreign Minister for Japan?s assistance in the Mindanao peace process. Since 2006, the Japan-Bangsamoro Initiatives for Reconstruction and Development (J-BIRD) contributed to the peace process through socio-economic infrastructure projects amounting to P5.5 billion, Japan also participates in the International Monitoring Team (IMT) in rehabilitation efforts, humanitarian assistance and in monitoring the ceasefire and in the International Contact Group (ICG) as an observer in the peace talks. Japan is the only country that is a member of both IMT and ICG in the Mindanao peace process.
I expressed the Philippine government?s appreciation to the Japanese government and people for their timely and substantial assistance to those affected by typhoon Pablo. The Japanese government provided emergency relief goods worth approximately P21 million and extended emergency grant aid amounting to P171 million for a response action plan for recovery through various UN agencies. Japanese local governments, private corporations, and non-profit organizations have also extended cash donations and pledges amounting to P11.5 million.
I look forward to meet Foreign Minister Kishida again in the near future and to closely work together in enhancing the strategic partnership between our two countries.
